All intellectual property in the "Reliant Driver Training" name, brand, logo, website, and domain names vests exclusively in Colin Fairnie.

By accessing this Website, submitting an enquiry, booking a lesson, or registering as an Instructor Partner, you agree to be bound by these Terms in full. If you do not accept these Terms, you must not use this Website or our services.

We reserve the right to amend these Terms at any time without prior notice. Continued use of the Website following any amendment constitutes your acceptance of the revised Terms. The date of the most recent revision is shown at the top of this page.

2. Nature of Our Service — Introduction & Referral Only

IMPORTANT: "Reliant Driver Training" is a trading name owned and operated by Colin Fairnie. The business operates solely as a driving school introduction and referral service. We connect learner drivers and other customers ("Students") with self-employed, independent driving instructors ("Instructor Partners") who have agreed to operate under the Reliant Driver Training brand.

Reliant Driver Training does NOT directly employ driving instructors. All Instructor Partners are independent, self-employed contractors. The driving tuition itself is delivered solely by the Instructor Partner, not by Colin Fairnie.

By booking a lesson through us, you are entering into a direct service arrangement with the individual Instructor Partner assigned to you. Colin Fairnie, trading as Reliant Driver Training, acts only as an intermediary to facilitate that introduction and takes no part in, and accepts no responsibility for, the delivery of driving tuition.

We make no guarantee that a specific instructor will be available in your area at any given time. Availability is subject to change without notice.

3. Instructor Partners — Independent Contractors & Absolute Exclusion of Liability

3.1 INDEPENDENT CONTRACTOR STATUS: All Instructor Partners are independent, self-employed contractors. They are not employees, workers, agents, sub-contractors, or representatives of Colin Fairnie or Reliant Driver Training. Nothing in these Terms, in any agreement between Colin Fairnie and an Instructor Partner, or in any course of dealing, shall be construed as creating an employment relationship, agency, joint venture, partnership, or any other form of legal association between Colin Fairnie and any Instructor Partner.

3.2 NO INVOLVEMENT IN TUITION: Colin Fairnie and Reliant Driver Training have no involvement whatsoever in the delivery of driving tuition. We do not supervise, direct, control, or oversee any Instructor Partner in the performance of their instruction activities. We do not set lesson content, lesson structure, or teaching methods. We do not accompany any lesson. We are not present during any lesson.

3.3 ABSOLUTE EXCLUSION OF LIABILITY — STUDENT AND INSTRUCTOR RELATIONSHIP: TO THE FULLEST EXTENT PERMITTED BY LAW, COLIN FAIRNIE TRADING AS RELIANT DRIVER TRAINING ACCEPTS ABSOLUTELY NO RESPONSIBILITY AND SHALL HAVE NO LIABILITY WHATSOEVER — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE — FOR ANY MATTER ARISING OUT OF OR IN CONNECTION WITH THE RELATIONSHIP BETWEEN A STUDENT AND AN INSTRUCTOR PARTNER. THIS INCLUDES WITHOUT LIMITATION: (a) any act, omission, negligence, misconduct, breach of duty, or breach of contract by any Instructor Partner; (b) any accident, incident, collision, injury, death, or property damage occurring during or in connection with a lesson; (c) the quality, standard, or outcome of any driving tuition; (d) any failure by an Instructor Partner to hold a valid ADI or PDI licence; (e) any failure by an Instructor Partner to maintain adequate insurance or a roadworthy vehicle; (f) any dispute between a Student and an Instructor Partner regarding payment, cancellation, conduct, or any other matter; (g) any loss, damage, or harm of any kind suffered by a Student as a result of their dealings with an Instructor Partner.

3.4 DIRECT RELATIONSHIP: Any contract for driving tuition is made directly and exclusively between the Student and the Instructor Partner. Colin Fairnie trading as Reliant Driver Training is not a party to that contract. Any complaint, claim, or dispute arising from the conduct or performance of an Instructor Partner must be directed to that Instructor Partner directly and/or to the relevant regulatory authority (DVSA). Colin Fairnie has no obligation to mediate, arbitrate, or resolve any such dispute.

3.5 INSTRUCTOR VETTING: While we take reasonable steps to verify that Instructor Partners hold a valid ADI or PDI licence at the time of registration, we do not continuously monitor their licence status, conduct, vehicle condition, or insurance. We strongly encourage Students to verify their instructor's ADI badge before commencing lessons. Verification of an instructor's ADI status does not create any liability on the part of Colin Fairnie for the instructor's subsequent conduct.

3.6 PASS RATES & OUTCOMES: Reliant Driver Training, operated by Colin Fairnie, makes no guarantee of any specific pass rate or learning outcome. Driving test results depend entirely on the individual Student's ability and the instruction provided by the Instructor Partner. No statement on this Website constitutes a guarantee of any specific outcome.

4. Student Bookings & Payments

4.1 BOOKING: When you submit an enquiry or booking request through our Website, you are requesting that we introduce you to a suitable Instructor Partner. A booking is not confirmed until you have received written or verbal confirmation from us or the assigned Instructor Partner.

4.2 PAYMENTS: Lesson fees are paid directly to the Instructor Partner unless otherwise stated. Colin Fairnie, trading as Reliant Driver Training, is not responsible for collecting, holding, or refunding lesson payments made directly to Instructor Partners. Any payment dispute between a Student and an Instructor Partner is a matter solely between those parties.

4.3 CANCELLATIONS: Cancellation and refund policies are set by each individual Instructor Partner. Colin Fairnie is not liable for any refusal to refund or any dispute arising from cancellation of lessons. We recommend you agree cancellation terms with your Instructor Partner before commencing lessons.

4.4 INTENSIVE COURSES: Where intensive course packages are sold directly through Reliant Driver Training, specific cancellation terms will be provided at the time of purchase. These terms will take precedence over this general clause.

4.5 PRICING: All prices displayed on this Website are indicative and subject to change. Final pricing will be confirmed at the time of booking. Colin Fairnie reserves the right to amend prices at any time without prior notice.

4.6 CONTACT DETAIL EXCHANGE ON MATCH: By submitting an enquiry through this Website, you expressly consent to your contact details (including your name, phone number, email address, and postcode) being shared with the Instructor Partner who accepts your enquiry. This sharing of contact details is necessary to fulfil the introduction and referral service and forms the basis of the contract between you and Colin Fairnie. You will receive an email confirmation at the point your details are shared. If you do not wish your details to be shared with an Instructor Partner, you must not submit an enquiry through this Website.

4A. Data Sharing — Student & Instructor Contact Exchange

4A.1 PURPOSE OF DATA SHARING: The core service provided by Reliant Driver Training is the introduction of Students to Instructor Partners. To fulfil this service, it is necessary for Colin Fairnie to share certain personal contact information between matched Students and Instructor Partners. This section explains what data is shared, when, and on what legal basis.

4A.2 WHAT IS SHARED WITH THE INSTRUCTOR: When an Instructor Partner accepts a student enquiry, the following student information is shared with that Instructor Partner: (a) first name and last name; (b) phone number; (c) email address; (d) postcode; (e) preferred gearbox type (manual or automatic); (f) any additional details provided in the enquiry message. Where the student has completed a full registered profile, additional information may also be shared, including: date of birth, licence number, theory test status, and instructor gender preference.

4A.3 WHAT IS SHARED WITH THE STUDENT: When an Instructor Partner accepts a student enquiry, the following instructor information is shared with the Student: (a) first name and last name; (b) phone number; (c) vehicle make, model, and gearbox type; (d) instructor profile biography (if provided). The instructor's email address may also be shared where it has been provided for this purpose.

4A.4 LEGAL BASIS FOR SHARING: The sharing of contact details between Students and Instructor Partners is carried out on the legal basis of contractual necessity (Article 6(1)(b) UK GDPR) — it is necessary to perform the introduction and referral service that both parties have requested. By submitting an enquiry or registering as an Instructor Partner, both parties expressly consent to and acknowledge this data sharing as a condition of using our service.

4A.5 STUDENT CONSENT: By submitting an enquiry through this Website, you confirm that you have read and understood this clause and that you freely consent to your contact details being shared with a matched Instructor Partner. You will receive an email notification at the point your details are shared, confirming which instructor has been allocated to you.

4A.6 INSTRUCTOR PARTNER CONSENT: By registering as an Instructor Partner and accepting student enquiries, you confirm that you have read and understood this clause and that you freely consent to your contact details being shared with matched Students. You acknowledge that you will receive student contact details by email when you accept an enquiry.

4A.7 DATA HANDLING OBLIGATIONS: Both Students and Instructor Partners are responsible for handling any personal data received through this service in accordance with UK GDPR and all applicable data protection legislation. In particular, Instructor Partners must: (a) use student contact details only for the purpose of arranging and delivering driving lessons; (b) not share student data with any third party without the student's consent; (c) store student data securely; (d) delete or destroy student data when it is no longer required for the purpose for which it was shared.

4A.8 DATA RETENTION: Colin Fairnie retains enquiry and match data for a period of up to 3 years for the purposes of business administration, dispute resolution, and regulatory compliance. You may request deletion of your personal data at any time by contacting us at support@reliantdrivertraining.co.uk, subject to any overriding legal obligations.

4A.9 FURTHER INFORMATION: For full details of how Colin Fairnie collects, uses, stores, and protects personal data, please refer to our Privacy Policy at https://reliantdrivertraining.co.uk/privacy.

5. Instructor Partner Terms

5.1 ELIGIBILITY: To register as an Instructor Partner with Reliant Driver Training (operated by Colin Fairnie), you must hold a valid DVSA Approved Driving Instructor (ADI) licence or a valid Trainee Driving Instructor (PDI) licence. You must maintain this licence throughout your partnership with us. You are solely responsible for ensuring your licence remains valid and for notifying us immediately if it is revoked, suspended, or expires.

5.2 INDEPENDENT STATUS: You acknowledge and agree that you are an independent, self-employed contractor. You are not an employee, worker, or agent of Colin Fairnie or Reliant Driver Training. You are responsible for your own tax affairs, National Insurance contributions, and all other statutory obligations arising from your self-employment. Nothing in this arrangement creates a partnership, joint venture, employment, or agency relationship between you and Colin Fairnie.

5.3 BRAND PARTNERSHIP — NOT A FRANCHISE: This arrangement is a brand partnership only. Colin Fairnie does not supply a vehicle, does not set your lesson prices, and does not take any percentage, commission, or share of your lesson fees. You retain 100% of all income you charge to pupils. The only financial obligation to Colin Fairnie is the monthly partner fee described in clause 5.4.

5.4 PARTNER FEE & SUBSCRIPTION TERMS: The monthly partner fee covers: (a) supply of pupil leads in your chosen area; (b) marketing and promotion of your profile through Reliant Driver Training and associated channels; (c) administrative support; (d) use of the Reliant Driver Training brand name and materials in connection with your instruction activities, including signage on vehicles and business cards which may be supplied by Colin Fairnie. The monthly partner fee is payable in advance. Failure to maintain payments may result in suspension or termination of your partnership. Fees are non-refundable except at our sole discretion.

5.4A SUBSCRIPTION PRICING: Subscription fees are subject to change and may increase or decrease at the sole discretion of Colin Fairnie. Where a change in subscription fee is made, Colin Fairnie will give Instructor Partners no less than one calendar month's written notice of the change before it takes effect.

5.4B RIGHT TO TERMINATE PARTNERSHIP: Colin Fairnie reserves the right to terminate any Instructor Partner's subscription and partnership at our sole discretion, with or without cause, subject to giving one calendar month's written notice where reasonably practicable. We reserve the right to terminate immediately and without notice in cases of serious misconduct, ADI licence revocation, material breach of these Terms, or any conduct that brings the Reliant Driver Training brand into disrepute.

5.4C INSTRUCTOR'S RIGHT TO WITHDRAW: Instructor Partners have the right to withdraw from their subscription and partnership at any time. Upon withdrawal or termination of the subscription for any reason: (a) Colin Fairnie will no longer supply student leads or referrals to the Instructor Partner; (b) the Instructor Partner is no longer authorised to use the Reliant Driver Training name, logo, or any associated branding in any form whatsoever — including but not limited to vehicle signage, business cards, social media, advertising, and any other promotional or marketing materials; (c) the Instructor Partner must immediately remove or destroy all materials bearing the Reliant Driver Training name or branding. Any continued use of the Reliant Driver Training brand following termination will constitute infringement of the intellectual property rights of Colin Fairnie and may result in legal action.

5.4D BRAND USE DURING ACTIVE PARTNERSHIP: Whilst paying an active subscription and operating as an Instructor Partner in good standing, Instructor Partners are authorised to use the Reliant Driver Training brand name by way of signage on vehicles and business cards. Such branded materials may be supplied by Colin Fairnie to the Instructor Partner. This authorisation is a limited, non-exclusive, revocable licence and does not confer any ownership rights in the Reliant Driver Training brand or intellectual property, all of which remain vested exclusively in Colin Fairnie.

5.5 NO VEHICLE SUPPLIED: Colin Fairnie does not supply, lease, or finance a vehicle as part of this partnership. You are solely responsible for providing and maintaining your own suitable dual-control tuition vehicle.

5.6 YOUR RESPONSIBILITIES: As an Instructor Partner, you are solely responsible for: (a) maintaining a valid ADI or PDI licence; (b) ensuring your vehicle is roadworthy, has a valid MOT, and is covered by appropriate motor insurance including driving instruction cover; (c) maintaining appropriate public liability insurance; (d) your professional conduct with Students; (e) compliance with DVSA standards and all applicable laws; (f) any accidents, incidents, or claims arising from your instruction activities; (g) setting your own lesson prices and collecting payment directly from pupils.

5.7 INDEMNITY: You agree to indemnify, defend, and hold harmless Colin Fairnie and his officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your provision of driving instruction; (b) your breach of these Terms; (c) any negligent or wrongful act or omission by you; (d) any claim by a Student or third party arising from your instruction activities.

5.8 TERMINATION: Either party may terminate this partnership arrangement at any time by giving one calendar month's written notice. Colin Fairnie reserves the right to terminate immediately and without notice in cases of serious misconduct, ADI licence revocation, material breach of these Terms, or any conduct that brings the Reliant Driver Training brand into disrepute. Upon termination for any reason, the Instructor Partner must immediately cease all use of the Reliant Driver Training brand name and branding in all forms, including vehicle signage, business cards, and any other materials. See clause 5.4C for full post-termination obligations.

5.9 BRAND USE: You are granted a limited, non-exclusive, revocable licence to use the Reliant Driver Training name and branding solely in connection with your approved instructor activities and only for the duration of your active partnership. This licence is granted by Colin Fairnie and terminates immediately upon termination of your partnership for any reason. You must immediately cease all use of the Reliant Driver Training name, branding, and materials upon termination.
